Foreign Caregivers- Information Sheet  Regarding New Employment System

 

This notice contains very important information regarding changes in the system of employment and registration of Foreign Caregivers. This information may affect your legal status in Israel as well as your right to work in Israel—so please read carefully!!

 

As per the  new system for employment of  foreign caregivers, each caregiver and employer must register with one of the Licensed Recruitment Agencies for Caregivers as soon as possible and no later than 30/4/09. A list of the licensed agencies can be found at the government internet site: www.moital.gov.il (entry into the English site is at the top left side of the home page).

 

To register, the caregiver and the employer must contact one of the listed Licensed Recruitment Agencies  and fill out a registration application. Immediately after  filing of the application, the Agency must give the Caregiver and the employer each a Certificate of  Placement, stating that they have registered with the Agency.

 

The Certificate of Placement must include the date of registration, the  name, address and telephone number of the Agency, the name, address and I.D. Number of the Employer, and the Name and Passport Number of the Caregiver.

 

It is very important to save the Certificate of  Placement received from the Agency, as it provides proof that the worker has been legally registered according to the new system of employment.

 

As of  January 15th, 2009,   working visas of caregivers will be extended only after the caregiver and the employer have registered with a Licensed Recruitment Agency as set out above.

 

The Agency may not charge the Caregiver or the Employer any sum for registration or for issuance of the  Certificate of Placement.

 

 

The Agency may charge the Employer up to 70 NIS per month for services it must provide (such as quarterly visits, problem solving and help with medical insurance, social security, visas and permits). It may also charge the Employer up to 2000 NIS in cases in which the Agency actively recruits a new worker for an Employer (no further recruitment fee may be charged the employer until the end of 2009, even if the Agency recruits alternate caretakers for the employer during that period.)

 

No sum may be charged to the Caregiver for recruitment carried out after the arrival of the Caregiver in Israel. For Recruitment of a Caregiver abroad, the Agency may charge the Caregiver up to 3276 NIS ( this sum is updated annually).

 

The Agency will notify the Migration Authority in the Ministry of the Interior of the details of the  Caregivers and employers whom it has registered. The Migration Authority will check the details and notify the Agency---usually within 7 days--- if the Caregiver is authorized to work in Israel for the Employer.  The Agency will inform the Employer and the Caregiver of the decision of the Authority.

 

If the  employment is approved by the Authority, and as long as the  work  visa (B/1) of the Caregiver is in force, there is no need for any additional registration. If the work visa (B/1) of the Caregiver  needs to be renewed, the Agency will explain to  the Caregiver the renewal procedure and provide necessary assistance.

 

If the Employment is rejected by the Authority, the Agency will explain to the Caregiver the reason for the rejection, provide the Caregiver with a copy of the rejection notice, and notify him of the need to stop the employment and/or leave the country.

 

After registration with an Agency, the worker  and employer may  cancel their registration on condition that they  register with a different Agency. The new Agency must issue a new Certificate of Placement to the Caregiver and the Employer.

 

If the worker changes employers he must notify the Agency in which he is registered,  which will notify the Migration Authority of the change and issue a new Certificate of Placement.  If the Caregiver is dismissed or becomes unemployed he must notify the Agency, which must assist the Caregiver in finding new employment.

 

It is very important that you and your employer  register with  one of the Licensed Agencies  immediately and no later than 30/4/09.
